Subject: Civil Society Appeal to Protect the Right to Health in Gaza
In light of the ominous and tragic events resulting from the ongoing Israeli occupation of Palestine, and the inhumane siege of the people of Gaza that have severely impeded access to medical treatment, medicines, food and energy; in light of the Palestinian Authority’s new policies, which bans patients in Gaza to travel to Israel for essential medical treatment, including those suffering from cancer or heart conditions, and have, since the beginning of the year, led to the death of 13 people, most of who were children; in light of the outrageous international silence that has overlooked these blatant crimes against humanity; and in reference to Human Rights obligations and International Humanitarian Law, particularly:
· Article (3) of the Universal Declaration of Human Rights on the right of a person to life and to live in freedom and safety.
· Article (25-1) of the Universal Declaration of Human Rights on the right of every person to a standard of living that is sufficient for the health and well-being of themselves and their families, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond their control.
· Article (12) of the International Convention for Economic, Social and Cultural Rights which recognizes the right of everyone to the enjoyment of the highest attainable standard of physical and mental health, and particularly clause (2-d) which stipulates the full right to the creation of conditions which would assure to all medical service and medical attention in the event of sickness.
· Article (24) of the Convention on the Rights of the Child for the year 1989 which stipulates that children have the right to good quality healthcare – the best healthcare possible, and countries are obliged to provide the necessary medical assistance and healthcare to all children.
· The (fourth) principle of the UN Declaration of the Rights of the Child of the year 1959 stating that children are entitled to essential medical services, and to grow and develop in health, and that special care and protection shall be provided to both the child and their mother, as well as the (eighth) principle from the same Declaration, which emphasizes that children should in all circumstances be the first to receive protection and relief.
· The Geneva Convention Relative to the Protection of Civilian Persons in Time of War, referred to as the Fourth Geneva Convention of the year 1949 and also applies to cases of conflict and occupation, particularly Articles 17 and 23 which obliges conflicting parties to conclude local agreements for the evacuation from besieged or encircled areas of wounded, sick, infirm, and aged persons, children and maternity cases, and the passage of medical personnel and medical equipment to these areas, as well as Articles 31, 32 and 33, which prohibits collective punishment and the punishment of persons for offences that they have not committed.
And based on the 2012 report published by the UN Coordinator of Humanitarian Affairs in the Palestinian Territories Maxwell Gaylard that states that Gaza will be inhabitable by the year 2020 and that taking urgent measures to improve water and electricity supplies, and health and educational services, are absolutely fundamental, we the undersigned demand the following:
1. The United Nations to call on Israel to remove all restrictions placed on patients requiring medical assistance outside of Gaza, and to allow medical supplies and medical personnel immediate entry into Gaza,
2. The United Nations to call on the Palestinian Authority to immediately and fully revoke its decision to limit patients from receiving medical treatment outside of Gaza,
3. Call on the UN High Commissioner for Human Rights and the Special Rapporteur on the right to health to dispatch a fact-finding mission to investigate the impediments to the enjoyment of the right to health caused by the current siege and to take the decisive steps to confront these violations of international law, and
4. The United Nations to pressure Israel to immediately end its siege of Gaza, which has been in place for a decade and has denied its inhabitants of their basic livelihood needs.
